Terms of Service

The service

RealtyKit helps real estate professionals turn property photos and listing details into images and short videos for social media, and optionally publish them to connected accounts. We may add, change or remove features over time.

Your account

• You must be at least 18 to use RealtyKit.
• You sign in with Google and are responsible for activity on your account. Keep your Google account secure.
• If you use RealtyKit for a brokerage or team, you confirm you have authority to accept these terms on its behalf.

Plans and payments

• Paid plans are sold and billed through Whop. Whop’s terms also apply to your purchase.
• Subscriptions renew automatically at the end of each billing period until you cancel. Free trials convert to a paid plan unless you cancel before the trial ends.
• You can cancel at any time. You keep access until the end of the period you already paid for.
• Payments are non-refundable, including for partially used periods, except where the law requires otherwise.
• We may change prices. We will tell you in advance, and the new price applies from your next billing period.
• Prices do not include taxes unless stated.

Your content

You own the photos, listing details, logos and other material you add (“your content”), and the designs you export. You give us a limited licence to store, process and display your content only as needed to run RealtyKit for you, including publishing it where you ask us to.

You confirm that:

• You have the rights to use your content, including permission from the photographer, brokerage or MLS for any listing photos.
• Your listing information is accurate and not misleading.
• Your content does not break any law or anyone else’s rights.

Real estate advertising rules

You are responsible for making sure your marketing follows the rules that apply to you, including your brokerage’s policies, your real estate regulator’s advertising requirements, MLS rules, human rights and fair housing laws, and the rules of each social platform. RealtyKit provides templates, not legal or compliance advice.

Publishing to social media

If you connect Instagram, Facebook or another platform, you authorise us to publish the content you choose to that account. Your use of those platforms is governed by their own terms. We are not responsible for how a platform displays, limits or removes content, or for changes to their services that affect publishing.

Acceptable use

Don’t use RealtyKit to:

• Post false, misleading or discriminatory listings or ads.
• Upload content you don’t have the rights to.
• Spam, harass or impersonate anyone.
• Break, overload, scrape or reverse engineer the service, or get around plan limits.
• Resell or share access to your account.

Our property

RealtyKit, including its software, templates, designs and branding, belongs to us. You can use the designs you export to market your listings and your business, including commercially. You may not copy, resell or redistribute our templates or the app itself.

Third-party services

RealtyKit relies on services such as Google, Whop, PostHog and Meta. Their availability is outside our control, and their own terms and privacy policies apply to how they handle your information. See our Privacy Policy for details.

Availability

We work to keep RealtyKit running smoothly, but we don’t guarantee it will always be available or error-free. We may pause the service for maintenance or updates.

Ending your account

You can stop using RealtyKit and ask us to delete your account at any time. We may suspend or close your account if you break these terms or use the service in a way that could harm others or us. If we close your account without cause, we will refund any unused prepaid time.

Disclaimers

RealtyKit is provided “as is” and “as available”. To the extent the law allows, we make no promises about results, such as reach, engagement, leads or sales, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, RealtyKit will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $100.

Indemnity

If someone brings a claim against us because of your content or your breach of these terms, you agree to cover our reasonable losses and costs, including legal fees.

Governing law

These terms are governed by the laws of [Province] and the federal laws of Canada that apply there. Disputes will be handled in the courts of [Province]. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

Changes to these terms

We may update these terms. If we make a material change, we will tell you by email or in the app before it takes effect. If you keep using RealtyKit after that, you accept the updated terms.
